Welcome to Mood Social Terms of Use!
These Terms govern your use of Mood and the products, features, app, services, technologies, and software we offer (Mood Social Products) except where we expressly state that separate terms (and not these) apply.
1. Our Services
Our mission is to give people the power to build community and bring the world closer together. To help advance this mission, we provide the products and services described below to you:
Provide a personalized experience for you:
Your experience on Mood Social is unlike anyone else's: from the posts, events, moods, and other content you see in the Feed or to the places you follow and other features you might use such as search. We use the data we have - for example, about the connections you make, the choices and settings you select, and what you share and do on and off our Products - to personalize your experience.
Connect you with people and organizations you care about:
We help you find and connect with people, businesses, organizations, and others that matter to you across Mood social products you use. We use the data we have to make suggestions for you and others - for example, events/moods to attend, places to follow, and people you may want to become friends with. Stronger ties make for better communities, and we believe our services are most useful when people are connected to people, and organizations they care about.
Empower you to express yourself and communicate about what matters to you:
There are many ways to express yourself on Mood Social and to communicate with friends, family, and others about what matters to you - for example, sharing status updates, photos on Mood social you use, commenting to a friend or several people, creating events or moods, or adding content to your profile. We also have developed, and continue to explore, new ways for people to use technology.
Help you discover content, products, and services that may interest you:
We show you ads, offers, and other sponsored content to help you discover content, products, and services that are offered by the many businesses and organizations that use Mood Social and other Mood Social products. Our partners pay us to show their content to you, and we design our services so that the sponsored content you see is as relevant and useful to you as everything else you see on our Products.
Combat harmful conduct and protect and support our community:
People will only build community on Mood Social if they feel safe. We will take appropriate action - for example, offering help, removing content, blocking access to certain features, disabling an account, or contacting law enforcement.
Research ways to make our services better:
We engage in research and collaborate with others to improve our Products. One way we do this is by analyzing the data we have and understanding how people use our Products.
2. Our Data policy and Your Privacy Choices
We collect and use your personal data in order to provide the services described above to you. You can learn about how we collect and use your data in our Data Policy.
We also encourage you to review the privacy choices you have about the ways in which we use data in your settings.
3. Your Commitments to Mood Social and Our Community.
We provide these services to you and others to help advance our mission. In exchange, we need you to make the following commitments:
1. Who can use Mood social
When people stand behind their opinions and actions, our community is safer and more accountable. For that reason, you must:
Use the same name that you use in everyday life.
Provide accurate information about yourself.
Create only one account (your own)
Not share your password, give access to your Mood social account to others, or transfer your account to anyone else (without our permission).
We try to make Mood Social broadly available to everyone, but you cannot use Mood Social if:
You are under 18 years old.
You are a convicted sex offender.
We previously disabled your account for violations of our terms or policies.
You are prohibited from receiving our products, services, or software under applicable laws.
2. What you can share and do on Mood Social
We want people to use Mood Social to express themselves and to share content that is important to them, but not at the expense of the safety and well-being of others or the integrity of our community. You therefore agree not to engage in the conduct described below (or to facilitate or support others in doing so):
You may not use our Products to do or share anything:
That violates these Terms, our Community Standards, and other terms and policies that apply to your use of Mood Social.
That is unlawful, misleading, discriminatory or fraudulent.
That infringes or violates someone else's rights.
You may not upload viruses or malicious code or do anything that could disable, overburden, or impair the proper working or appearance of our Products.
You may not access or collect data from our Products using automated means (without our prior permission) or attempt to access data you do not have permission to access.
We can remove content you share in violation of these provisions and, if applicable, we may take action against your account, for the reasons described below (Account Suspension or Termination). We may also disable your account if you repeatedly infringe other people's intellectual property rights.
Where appropriate, we will take steps to notify you when we remove your content for violating our Community Standards. We may not be able to provide notice in all cases, for example if we are prohibited from doing so by law or where it might harm our community or the integrity of our Products.
To help support our community, we encourage you to report content or conduct that you believe violates your rights (including intellectual property rights) or our terms and policies.
3. The permissions you give us
We need certain permissions from you to provide our services:
Permission to use content you create and share: You own the content you create and share on Mood social and Mood Social products and nothing in these Terms takes away the rights you have to your own content. You are free to share your content with anyone else, wherever you want. To provide our services, though, we need you to give us some legal permissions to use that content.
Specifically, when you share, post, or upload content that is covered by intellectual property rights (like photos or videos) on or in connection with our Products, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content (consistent with your privacy and application settings). This means, for example, that if you share a photo on Mood Social, you give us permission to store, copy, and share it with others (again, consistent with your settings) such as service providers that support our service or other Mood Social products.
You can end this license any time by deleting your content or account. You should know that, for technical reasons, content you delete may persist for a limited period of time in backup copies (though it will not be visible to other users). In addition, content you delete may continue to appear if you have shared it with others and they have not deleted it.
Permission to use your name, profile picture, and information about your actions with ads and sponsored content: You give us permission to use your name and profile picture and information about actions you have taken on Mood Social next to or in connection with ads, offers, and other sponsored content that we display across our Products, without any compensation to you. For example, we may show your friends that you are interested in an advertised event or have liked a Page created by a brand that has paid us to display its ads on Mood Social. Ads like this can be seen only by people who have your permission to see the actions you've taken on Mood Social.
Permission to update software you use or download: If you download or use our software, you give us permission to download and install upgrades, updates, and additional features to improve, enhance, and further develop it.
4. Limits on using our intellectual property
If you use content covered by intellectual property rights that we have and make available in our Products (for example, images, designs, videos, or sounds we provide that you add to content you create or share o Mood Social), we retain all rights to that content (but not yours). You can only use our copyrights with our prior written permission. You must obtain our written permission (or permission under an open-source license) to modify, create derivative works of, decompile, or otherwise attempt to extract source code from us.
4. Additional Provisions
1. Updating our Terms
We work constantly to improve our services and develop new features to make our Products better for you and our community. As a result, we may need to update these Terms from time to time to accurately reflect our services and practices. Unless otherwise required by law, we will notify you (for example, by email or through our Products) at least 30 days before we make changes to these Terms and give you an opportunity to review them before they go into effect. Once any updated Terms are in effect, you will be bound by them if you continue to use our Products.
We hope that you will continue using our Products, but if you do not agree to our updated Terms and no longer want to be a part of the Mood community, you can delete your account at any time.
2. Account suspension or termination
We want Mood Social to be a place where people feel welcome and safe to express themselves and share their thoughts and ideas.
If we determine that you have clearly, seriously, or repeatedly violated our terms or policies, including in particular our Community Standards, we may suspend or permanently disable access to your account. We may also suspend or disable your account if we required to do so by law. Where appropriate, we will notify you about your account the next time you try to access it. There will be a pop-up notifying you about your account being deactivated and also how to contact us if you think we have disabled your account by mistake.
If you delete or we disable your account, these Terms shall terminate as an agreement between you and us, but the following provisions will remain in place: 3, 4.2-4.5
3. Limits on liability
We will use reasonable skill and care in providing our Products to you and in keeping a safe, secure, and error-free environment, but we cannot guarantee that our Products will always function without disruptions, delays, or imperfections. Provided we have acted with reasonable skill and care, we do not accept responsibility for: losses not caused by our breach of these Terms or otherwise by our acts; losses which are not reasonably foreseeable by you and us at the time of entering into these Terms; any offensive, inappropriate, obscene, unlawful, or otherwise objectionable content posted by others that you may encounter on our Products; and events beyond our reasonable control.
The above does not exclude or limit our liability for death, personal injury, or fraudulent misrepresentation caused by our negligence. It also does not exclude or limit our liability for any other things where the law does not permit us to do so.
4. Disputes
We try to provide clear rules so that we can limit or hopefully avoid disputes between you and us. If a dispute does arise, however, it's useful to know upfront where it can be resolved and what laws will apply.
If you are a consumer and habitually reside in a Member State of the European Union, the laws of that Member State will apply to any claim, cause of action, or dispute you have against us that arises out of or relates to these Terms or the Mood Social app, and you may resolve your claim in any competent court in that Member State that has jurisdiction over the claim.
5. Other
These Terms make up the entire agreement between you and Mood Social regarding your use of our Products. They supersede any prior agreements.
Some of the products we offer are also governed by supplemental terms. If you use any of those Products, you will be provided with an opportunity to agree to supplemental terms that will become part of our agreement with you. For instance, if you access or use our Products for commercial or business purposes, such as buying ads, selling products, developing apps, managing a group or Page for your business, or using our measurement services, you must agree to our Commercial Terms. To the extent any supplemental terms conflict with these Terms, the supplemental terms shall govern to the extent of the conflict.
If any portion of these Terms are found to be unenforceable, the remaining portion will remain in full force and effect. If we fail to enforce any of these Terms, it will not be considered a waiver. Any amendment to or waiver of these Terms must be made in writing and signed by us.
You will not transfer any of your rights or obligations under these Terms to anyone else without our consent.
These Terms do not confer any third-party beneficiary rights. All of our rights and obligations under these Terms are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.
You should know that we may need to change the username for your account in certain circumstances (for example, if someone else claims the username and it appears unrelated to the name you use in everyday life).
We always appreciate your feedback and other suggestions about our products and services. But you should know that we may use them without any restriction or obligation to compensate you, and we are under no obligation to keep them confidential.
We reserve all rights not expressly granted to you.
5. Other terms and policies that may apply to you
Community Standards: These guidelines outline our standards regarding the content Mood Social Products.
Data Policy: This policy describes the information we process to support Mood Social, and other products and features offered by Mood Social. You can find additional tools and information in the Mood Social settings.
Commercial Terms: These terms apply if you also access or use our Products for any commercial or business purpose, including advertising, operating an app on our Platform, using our measurement services, managing a group or a Page for a business, or selling goods or services.
Cookies Policy: This policy explains how we use cookies and the choices you have. Except as otherwise stated in this policy, the Data Policy will apply to our processing of the data we collect via cookies.
Places, Events and Moods Policy: These guidelines apply if you create or administer a Mood Social Place, Event, or Mood, or if you use Mood Social to communicate or administer a promotion.
Commerce Policies: These guidelines outline the policies that apply when you offer products and services for sale on Mood Social.
Mood Social Brand Resources: These guidelines outline the policies that apply to use of Mood Social trademarks, logos, and screenshots.
Community Standards
Every day, people come to Mood Social to share their Moods, connect with friends based on what they are in the Mood for and discover new places and activities. The activities that happen on Mood Social reflect the diversity of a community and bring together all sorts of people who share different or similar interests.
We recognize how important it is for Mood Social to be a place where people feel empowered to communicate, and we take our role in keeping abuse off our service seriously. That’s why we have developed a set of Community Standards that outline what is and is not allowed on Mood Social. Our Standards apply around the world to all types of content. They’re designed to be comprehensive – for example, activities that might not be harmful but deemed inappropriate may still be removed for violating our policies.
The goal of our Community Standards is to encourage expression and create a safe environment. Our policies are rooted in the following principles:
Safety: People need to feel safe in order to build a community. We are committed to removing content that encourages real-world harm, including (but not limited to) physical, financial, and emotional injury.
Voice: Our mission is all about embracing diverse views. We err on the side of allowing content, even when some find it objectionable unless removing that content can prevent a specific harm. Moreover, at times we will allow content that might otherwise violate our standards if we feel that it is newsworthy, significant, or important to the public interest. We do this only after weighing the public interest value of the content against the risk of real-world harm.
Equity: Our community is global and diverse. Our policies may seem broad, but that is because we apply them consistently and fairly to a community that transcends regions, cultures. As a result, our Community Standards can sometimes appear less nuanced than we would like, leading to an outcome that is at odds with their underlying purpose. For that reason, in some cases, and when we are provided with additional context, we make a decision based on the spirit, rather than the letter, of the policy.
Everyone on Mood Social plays a part in keeping the platform safe and respectful. We want people to share responsibly and to let us know when they see something that may violate our Community Standards. We make it easy for people to report potentially violating content, including Profiles, Activities, individual content, and/or comments to us for review. We also give people the option to block people or unfollow places, so that they can control their own experience on Mood Social.
The consequences for violating our Community Standards vary depending on the severity of the violation and a person's history on the platform. For instance, we may warn someone for a first violation, but if they continue to violate our policies, We may disable their profile. We also may notify law enforcement when we believe there is a genuine risk of physical harm or a direct threat to public safety.
Our Community Standards, which we will continue to develop over time, serve as a guide for how to communicate on Mood Social. It is in this spirit that we ask members of the Mood Social community to follow these guidelines.
1. Credible Violence
We aim to prevent potential real-world harm that may be related to content on Mood Social. We understand that people commonly express disdain or disagreement by threatening or calling for violence in facetious and non-serious ways. That's why we try to consider the language, context and details in order to distinguish casual statements from content that constitutes a credible threat to public or personal safety. In determining whether a threat is credible, we may also consider additional information like a targeted person's public visibility and vulnerability. We remove content, disable accounts, and work with law enforcement when we believe there is a genuine risk of physical harm or direct threats to public safety.
2. Dangerous Individuals and Organizations
In an effort to prevent and disrupt real-world harm, we do not allow any organizations or individuals that are engaged in the following to have a presence on Mood Social:
Terrorist activity
Organized hate
Mass or serial murder
Human trafficking
Organized violence or criminal activity
We also remove content that expresses support or praise for groups, leaders, or individuals involved in these activities.
3. Promoting or Publicizing Crime
We prohibit people from promoting or publicizing violent crime, theft, and/or fraud because we do not want to condone this activity and because there is a risk of copycat behavior. We also do not allow people to depict criminal activity or admit to crimes they or their associates have committed. We do, however, allow people to debate or advocate for the legality of criminal activities, as well as address them in a rhetorical or satirical way.
4. Coordinating Harm
In an effort to prevent and disrupt real-world harm, we prohibit people from facilitating or coordinating future criminal activity that is intended or likely to cause harm to people, businesses, or animals. People can draw attention to harmful activity that they may witness or experience as long as they do not advocate for or coordinate harm.
5. Regulated Goods
To encourage safety and compliance with common legal restrictions, we prohibit attempts by individuals, manufacturers, and retailers to purchase, sell, or trade non-medical drugs, pharmaceutical drugs, and marijuana. We also prohibit the purchase, sale, gifting, exchange, and transfer of firearms, including firearm parts or ammunition, between private individuals on Mood Social. Some of these items are not regulated everywhere; however, because of the borderless nature of our community, we try to enforce our policies as consistently as possible. Firearm stores and online retailers may promote items available for sale off of our services as long as those retailers comply with all applicable laws and regulations. We allow discussions about sales of firearms and firearm parts in stores or by online retailers and advocating for changes to firearm regulation. Regulated goods that are not prohibited by our Community Standards may be subject to our more stringent Commerce Policies.
6. Suicide and Self-Injury
In an effort to promote a safe environment on Mood Social, we remove content that encourages suicide or self-injury, including real-time depictions that might lead others to engage in similar behavior. Self-injury is defined as the intentional and direct injuring of the body, including self-mutilation and eating disorders. We want Mood Social to be a space where people can share their Moods, raise awareness about these issues, and support each other through difficult experiences, and so we allow people to discuss suicide and self-injury through activities. We encourage people to offer and to seek support from one another in connection with these difficult topics.
We remove any content that identifies and negatively targets victims or survivors of self-injury or suicide seriously, humorously, or rhetorically. People can, however, share information about self-injury and suicide to draw attention to the issue and allow for discussion so long as they do not promote or encourage self-injury or suicide.
7. Child Nudity and Sexual Exploitation of Children
We do not allow content that sexually exploits or endangers children. When we become aware of apparent child exploitation, we report it to law enforcement. We know that sometimes people share nude images of their own children with good intentions; however, we generally remove these images because of the potential for abuse by others and to help avoid the possibility of other people reusing or misappropriating the images.
8. Sexual Exploitation of Adults
We recognize the importance of Mood Social as a place to discuss and draw attention to sexual violence and exploitation. We believe this is an important part of building a common understanding and community. In an effort to create space for this conversation while promoting a safe environment, we remove content that depicts, threatens or promotes sexual violence, sexual assault, or sexual exploitation, while also allowing space for victims to share their experiences. We remove content that displays, advocates for, or coordinates sexual acts with non-consenting parties or commercial sexual services. We do this to avoid facilitating transactions that may involve trafficking, coercion, and non-consensual sexual acts. "Sexual services" include prostitution, escort services, sexual massages, and filmed sexual activity.
To protect victims and survivors, we also remove images that depict incidents of sexual violence and intimate images shared without permission from the people pictured.
9. Bullying
Bullying happens in many places and comes in many forms from making statements degrading someone's character to posting inappropriate images to threatening someone. We do not tolerate bullying on Mood Social because we want the members of our community to feel safe and respected.
We will remove content that purposefully targets private individuals with the intention of degrading or shaming them. Furthermore, we recognize that bullying can be especially harmful to minors, and our policies provide heightened protection for minors because they are more vulnerable and susceptible to online bullying. To protect minors further, we have set the minimum age to register from 18 years. In certain instances, we require the individual who is the target of bullying to report content to us before removing it.
Our bullying policies do not apply to public figures because we want to allow discourse, which often includes critical discussion of people who have a large public audience. Discussion of public figures nonetheless must comply with our Community Standards, and we will remove content about public figures that violates other policies, including hate speech or credible threats.
10. Harassment
We do not tolerate harassment on Mood Social. We want people to feel safe to engage and connect with their community. Our harassment policy applies to both public and private individuals because we want to prevent unwanted or malicious contact on the platform. Context and intent matter, and we allow people to create activities if it is clear that something was shared in order to condemn or draw attention to harassment. In addition to reporting such behavior and content, we encourage people to use tools available on Mood Social to help protect against it.
11. Privacy Violations and Image Privacy Rights
Privacy and the protection of personal information are fundamentally important values for Mood Social. We work hard to keep your account secure and safeguard your personal information in order to protect you from potential physical or financial harm. You should not post personal or confidential information about others without first getting their consent. We also provide people ways to report imagery that they believe to be in violation of their privacy rights.
12. Hate Speech
We do not allow hate speech on Mood Social because it creates an environment of intimidation and exclusion and in some cases may promote real-world violence.
We define hate speech as a direct attack on people based on what we call protected characteristics — race, ethnicity, national origin, religious affiliation, sexual orientation, caste, sex, gender, gender identity, and serious disease or disability. We define attack as violent or dehumanizing speech, statements of inferiority, or calls for exclusion or segregation. We separate attacks into three tiers of severity, as described below.
Sometimes people share content containing someone else’s hate speech for the purpose of raising awareness or educating others. Similarly, in some cases, words or terms that might otherwise violate our standards are used self-referentially or in an empowering way. When this is the case, we allow the content, but we expect people to clearly indicate their intent, which helps us better understand why they shared it. Where the intention is unclear, we may remove the content.
We allow humor and social commentary related to these topics. In addition, we believe that people are more responsible when they share this kind of commentary using their authentic identity.
13. Violence and Graphic Content
We remove content that glorifies violence or celebrates the suffering or humiliation of others because it may create an environment that discourages participation. We allow graphic content (with some limitations) to help people raise awareness about issues. We know that people value the ability to discuss important issues like human rights abuses or acts of terrorism.
14. Adult Nudity and Sexual Activity
We restrict the display of nudity or sexual activity because some people in our community may be sensitive to this type of content. Additionally, we default to removing sexual imagery to prevent the sharing of non-consensual or underage content. Restrictions on the display of sexual activity also apply to digitally created content unless it is posted for educational, humorous, or satirical purposes.
Our nudity policy has become more nuanced over time. We understand that nudity can be shared for a variety of reasons, including as a form of protest, to raise awareness about a cause, or for educational or medical reasons. Where such intent is clear, we make allowances for the content. For example, while we restrict some images of female breasts that include the nipple, we allow other images, including those depicting acts of protest, women actively engaged in breastfeeding, and photos of post-mastectomy scarring. We also allow photographs of paintings, sculptures, and other art that depicts nude figures.
15. Cruel and Insensitive
We believe that people share and connect more freely when they do not feel targeted based on their vulnerabilities. As such, we have higher expectations for content that we call cruel and insensitive, which we define as content that targets victims of serious physical or emotional harm.
16. Spam
We work hard to limit the spread of commercial spam to prevent false advertising, fraud, and security breaches, all of which detract from people's ability to share and connect. We do not allow people to use misleading or inaccurate information to collect likes or followers.
17. Misrepresentation
Authenticity is the cornerstone of our community. We believe that people are more accountable for their statements and actions when they use their authentic identities. That's why we require people to connect on Mood Social using the name they go by in everyday life. Our authenticity policies are intended to create a safe environment where people can trust and hold one another accountable.
Respecting Intellectual Property
20. Intellectual Property
Mood Social takes intellectual property rights seriously and believes they are important to promoting expression, creativity, and innovation in our community. You own all the content and information you post on Mood Social, and you control how it is shared through your privacy and application settings. However, before sharing content on Mood Social, please be sure you have the right to do so. We ask that you respect other people’s copyrights, trademarks, and other legal rights. We are committed to helping people and organizations promote and protect their intellectual property rights. Mood Socials Terms of Service do not allow people to post content that violates someone else’s intellectual property rights, including copyright and trademark.

User requests for removal of their own account
Requests for removal of a deceased user’s account from a verified immediate family member or executor
Requests for removal of an incapacitated user’s account from an authorized representative

Government requests for removal of child abuse imagery depicting, for example, beating by an adult or strangling or suffocating by an adult

Data Policy
This policy describes the information we process to support Mood Social, and other products and features offered by Mood Social. You can find additional tools and information in the Mood Social settings.
What kinds of information do we collect?
To provide Mood Social, we must process information about you. The types of information we collect depend on how you use our Products. You can learn how to access and delete the information we collect by visiting the Mood Social Settings and contacting us through our website at moodsocial.se or e-mailing us on support@moodsocial.se.
Things you and others do and provide.
Information and content you provide. We collect the content, communications and other information you provide when you use our Products, including when you sign up for an account, create or share content, and communicate with others. This can include information in or about the content you provide (like metadata), such as the location of a photo or the date a file was created. Our systems automatically process content and communications you and others provide to analyze context and what's in them for the purposes described below.
Data with special protections: You can choose to provide information in your Mood Social profile about your religious views, political views, who you are "interested in," or your health. This and other information (such as racial or ethnic origin, philosophical beliefs or trade union membership) is subject to special protections under EU law.
Networks and connections. We collect information about the people, Pages, accounts and activities you are connected to and how you interact with them across our Products, such as people you communicate with the most or activities you are part of. We also collect contact information if you choose to upload, sync or import it from a device (such as an address book or call log or SMS log history), which we use for things like helping you and others find people you may know and for the other purposes listed below.
Your usage. We collect information about how you use our Products, such as the types of content you view or engage with; the features you use; the actions you take; the people or accounts you interact with; and the time, frequency and duration of your activities. For example, we log when you're using and have last used our Products, and what posts, videos and other content you view on our Products.
Things others do and information they provide about you. We also receive and analyze content, communications and information that other people provide when they use our Products. This can include information about you, such as when others share or comment on a photo of you, or upload, sync or import your contact information.
Device Information
As described below, we collect information from and about the computers, phones, connected TVs and other web-connected devices you use that integrate with our Products, and we combine this information across different devices you use. For example, we use information collected about your use of our Products on your phone to better personalize the content or features you see when you use our Products on another device, such as your laptop or tablet, or to measure whether you took an action in response to an ad we showed you on your phone on a different device.
Information we obtain from these devices includes:
Device attributes: information such as the operating system, hardware and software versions, battery level, signal strength, available storage space, browser type, app and file names and types, and plugins.
Device operations: information about operations and behaviors performed on the device, such as whether a window is foregrounded or backgrounded, or mouse movements (which can help distinguish humans from bots).
Identifiers: unique identifiers, device IDs, and other identifiers, such as from games, apps or accounts you use.
Device signals: Bluetooth signals, and information about nearby Wi-Fi access points, beacons, and cell towers.
Data from device settings: information you allow us to receive through device settings you turn on, such as access to your GPS location, camera or photos.
Network and connections: information such as the name of your mobile operator or ISP, language, time zone, mobile phone number, IP address, connection speed and, in some cases, information about other devices that are nearby or on your network.

Location-related information can be based on things like precise device location (if you've allowed us to collect it), IP addresses, and information from your and others' use of Mood Social (such as check-ins or activities you attend).
Product research and development: We use the information we have to develop, test and improve our Products, including by conducting surveys and research, and testing and troubleshooting new products and features.

Sharing on Mood Social Products
People and accounts you share and communicate with
When you share and communicate using our Products, you choose the audience for what you share. For example, when you post on Mood Social, you select the audience for the post, all of your friends, the public, or a customized list of people. For example, when you create an event on Mood Social you can choose to make the event public or private.
Content others share or reshare about you
You should consider who you choose to share with, because people who can see your activity on our Products can choose to share it with others on and off our Products, including people and businesses outside the audience you shared with. For example, when you share a post or communicate to specific friends or accounts, they can download, screenshot, or reshare that content to others across or off our Products, in person. Also, when you comment on someone else's post or react to their content, your comment or reaction is visible to anyone who can see the other person's content, and that person can change the audience later.
People can also use our Products to create and share content about you with the audience they choose. For example, people can share a photo of you in a Story, mention or tag you at a location in a post, or share information about you in their posts. Information about your active status or presence on our Products.
People in your networks can see signals telling them whether you are active on our Products, including whether you are currently active on Mood Social or when you last used our products.
New owner.
If the ownership or control of all or part of our Products or their assets changes, we may transfer your information to the new owner.
Sharing with Third-Party Partners
We work with third-party partners who help us provide and improve our Products or who use Mood Business Tools to grow their businesses, which makes it possible to operate our companies and provide free services to people around the world. Companies can pay via a subscription fee to have access to statistics regarding who visits their business through Mood Social. However the statistics never shows your personal information such as your profile but your actions such as like, follow or check in can be seen through the statistics. We also impose strict restrictions on how our partners can use and disclose the data we provide. Here are the types of third parties we share information with:
Partners who use our analytics services.
We provide aggregated statistics and insights that help people and businesses understand how people are engaging with their posts, listings, Pages, videos and other content on and off the Mood Social Products. For example, Page admins, business profiles receive information about the number of people or accounts who viewed, reacted to, or commented on their posts, as well as aggregate demographic and other information that helps them understand interactions with their Page or account.
Advertisers.
We provide advertisers with reports about the kinds of people seeing their ads and how their ads are performing, but we don't share information that personally identifies you (information such as your name or email address that by itself can be used to contact you or identifies who you are) unless you give us permission. For example, we provide general demographic and interest information to advertisers (for example, that an ad was seen by a woman between the ages of 25 and 34 who lives in Madrid and likes software engineering) to help them better understand their audience.
Measurement partners.
We share information about you with companies that aggregate it to provide analytics and measurement reports to our partners.
Partners offering goods and services in our Products.
When you subscribe to receive premium content, or buy something from a seller in our Products, the content creator or seller can receive your public information and other information you share with them, as well as the information needed to complete the transaction, including shipping and contact details.

Data retention, account deactivation and deletion
We store data until it is no longer necessary to provide our services and Mood Social Products, or until your account is deleted - whichever comes first. This is a case-by-case determination that depends on things like the nature of the data, why it is collected and processed, and relevant legal or operational retention needs..
When you delete your account, we delete things you have posted, such as your photos and status updates, and you won't be able to recover that information later. Information that others have shared about you isn't part of your account and won't be deleted. If you don't want to delete your account but want to temporarily stop using the Products, you can deactivate your account instead. How do we respond to legal requests or prevent harm?
We access, preserve and share your information with regulators, law enforcement or others:
In response to a legal request, if we have a good-faith belief that the law requires us to do so. We can also respond to legal requests when we have a good-faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards.

Mood Social Commercial Terms
The Mood Social Terms and these terms (the “Mood Social Commercial Terms” or “Commercial Terms”) apply to access or use of the Mood Social Products (or Products), including Mood Social Business Page, for any business or commercial purpose (except where we state that separate terms (and not these) apply to such access or use of a Mood Social Product). This includes, but is not limited to, buying ads, selling products, developing apps, Page for a business, or using our measurement services.
You agree that you will ensure that any third party on whose behalf you access or use any Mood Social Product for any business or commercial purpose (except, again, where we state that separate terms (and not these) apply to such access or use) is bound by the Terms, these Commercial Terms and any applicable supplemental terms, and you represent and warrant that you have the authority to bind that third party to such terms.
These Commercial Terms require the resolution of most disputes between you and us by binding arbitration on an individual basis; class actions and jury trials are not permitted.
Licenses: As described in “The permissions you give us” section in our Terms, you grant us a license to content that is covered by intellectual property rights (like photos or videos) you share, post, or upload on or in connection with our Products. For any access or use of the Mood Social Products for business or commercial purposes, that license applies to content you or someone on your behalf (such as your agency that places an ad for you or your service provider that manages your Page content for you) makes available on or in connection with any Mood Social Product.
You also will ensure that you own or have secured all rights necessary to grant the licenses and rights you (or someone on your behalf) grant to us under the Commercial Terms and any applicable supplemental terms, including permission to display, distribute and deliver your content within Mood Social Products.
Compliance with law: You represent and warrant that your access or use of Mood Social Products for business or commercial purposes complies with all applicable laws, rules, and regulations. You further represent that you will restrict access to your content and apps in accordance with all applicable laws, rules, and regulations, including geo-filtering or age-gating access where required.
In addition to and without limiting the requirements about who can use the Mood Social Products under our Terms, if you are located in a country that is subject to embargo under the laws of Sweden (or under similar laws applicable to you) you may not engage in commercial activities on Mood Social Products unless authorized by applicable laws.
Limits on liability: In addition to and without limiting the scope of the “Limits on liability” section in our Terms, you agree that we are not responsible for the actions, services, content, or data of third parties and you release us, our directors, officers, employees, and agents from any claims and damages, known or unknown, arising out of or in any way connected with any claim you have against any such third parties.
Our aggregate liability arising out of or relating to any access or use of the Mood Social Products for business or commercial purposes, the Terms (for any access or use of the Mood Social Products for business or commercial purposes), or these Commercial Terms shall not exceed the greater of one hundred dollars ($100) or the amount you have paid us in the past twelve months.
Disputes:
Indemnification. If anyone brings a claim, cause of action, or dispute against us related to your services, actions, content or information on Mood Social or other Mood Social Products or your use of any Mood Social Products, you agree to indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to any such claim, cause of action, or dispute.
Dispute resolution
If you reside outside Sweden or your business is located outside Sweden: You agree that any claim, cause of action, or dispute you have against us that arises out of or relates to any access or use of the Mood Social Products for business or commercial purposes must be resolved exclusively in Sweden.
If you reside in Sweden or your business is located in Sweden: You and we agree to arbitrate any claim, cause of action, or dispute between you and us that arises out of or relates to any access or use of the Mood Social Products for business or commercial purposes (“commercial claim”). This provision does not cover any commercial claims relating to violations of your or our intellectual property rights, including, but not limited to, copyright infringement, patent infringement, trademark infringement, violations of the Brand Usage Guidelines, violations of your or our confidential information or trade secrets, or efforts to interfere with our Products or engage with our Products in unauthorized ways (for example, automated ways).
We and you agree that, by entering into this arbitration provision all parties are waiving their respective rights to a trial by jury or to participate in a class or representative action. THE PARTIES AGREE THAT EACH MAY BRING COMMERCIAL CLAIMS AGAINST THE OTHER ONLY IN ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING. You may bring a commercial claim only on your own behalf and cannot seek relief that would affect other parties. If there is a final judicial determination that any particular commercial claim (or a request for particular relief) cannot be arbitrated in accordance with this paragraph’s limitations, then only that commercial claim (or only that request for relief) may be brought in court. All other commercial claims (or requests for relief) remain subject to this paragraph.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision. All issues are for an arbitrator to decide, except that only a court may decide issues relating to the scope or enforceability of this arbitration provision or the interpretation of the prohibition of class and representative actions.
If any party intends to seek arbitration of a dispute, that party must provide the other party with notice in writing. This notice of dispute to us must be sent to the following address:

Updates: We may need to update these Commercial Terms from time to time, including to accurately reflect the access or uses of our Products for business or commercial purposes, and so we encourage you check them regularly for any updates. By continuing any access or use of any Mood Social Products for business or commercial purposes after any notice of an update to these Commercial Terms, you agree to be bound by them. Any updates to the Disputes section of these Commercial Terms will apply only to disputes that arise after notice of the update takes place. If you do not agree to the updated terms, please stop all access or use of our Products for business or commercial purposes.
Conflicts and supplemental terms: If there is a conflict between the Commercial Terms and the Mood Social Terms, the Commercial Terms shall govern with respect to your access and use of the Mood Social Products for business or commercial purposes to the extent of the conflict.
Supplemental terms and policies may also apply to your use of certain Products. To the extent those supplemental terms conflict with the Commercial Terms, the supplemental terms will govern with respect to your use of those Products to the extent of the conflict.
As with our Commercial Terms, we may make changes to these supplemental terms. By continuing to access or use any Mood Social Products subject to supplemental terms after notice of any update to the supplemental terms, you agree to be bound by them.
Other
The Mood Social Terms, these Commercial Terms, and other applicable supplemental terms make up the entire agreement between the parties regarding access or use of the Mood Social Products for any business or commercial purpose, and supersede any prior agreements.
If any portion of these Commercial Terms are found to be unenforceable, then (except as otherwise provided) that portion will be severed and the remaining portion will remain in full force and effect.
If we fail to enforce any of these Commercial Terms, it will not be considered a waiver.
Any amendment to or waiver of these Commercial Terms must be made in writing and signed by us.
You will not transfer any of your rights or obligations under these Commercial Terms to anyone else without our consent.
These Commercial Terms do not confer any third party beneficiary rights.
You consent that Mood Social may disclose your advertising content and Page posts (“commercial content”), and all information associated with such content your advertising, including information associated with the delivery of that content, in response to valid legal process related to an electoral matter or to a governmental entity or body if Mood Social believes that disclosure would assist in a lawful investigation.
All of our rights and obligations under these Commercial Terms are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.
Nothing in these Commercial Terms shall prevent us from complying with the law.
We reserve all rights not expressly granted to you.

The following terms, as well as our policies and terms, apply to all creators and administrators of Places, Events and Moods on Mood Social. You are responsible for ensuring that your Places, Events and Moods complies with all applicable laws, statutes, and regulations.

Places, Events and Moods must not be misleading, fraudulent, or deceptive.

2. Impersonation
Places, Events and Moods must not impersonate or falsely represent a brand, entity, or public figure. Where a Places, Events and Moods is being used to express support for or interest in a brand, entity, or public figure, it must make clear in the name or description that it is not an official representation.

3. Promotions on Places, Events, and Moods
Communicating a Promotion
If you use Mood Social to communicate or administer a promotion (ex: a contest or sweepstakes), you are responsible for the lawful operation of that promotion, including:
The official rules;
Offer terms and eligibility requirements (ex: age and residency restrictions); and
Compliance with applicable rules and regulations governing the promotion and all prizes offered (ex: registration and obtaining necessary regulatory approvals).
Required Content
Promotions on Mood Social must include the following:
A complete release of Mood Social by each entrant or participant; and
Acknowledgement that the promotion is in no way sponsored, endorsed, administered by or associated with Mood Social.
Administration of a Promotion
Promotions may be administered on Places, Events or Moods. Personal Timelines and friend connections must not be used to administer promotions (ex: “share on your Timeline to enter” or “share on your friend's Timeline to get additional entries”, and "tag your friends in this post to enter" are not permitted).
Assisting Promotions
Mood Social will not assist you in the administration of your promotion, and you agree that if you use our service to administer your promotion, you do so at your own risk.
4. Collection of Data on Places, Events, and Moods
Collecting Data From Users
If you collect content and information directly from users, your Places, Events or Moods must make it clear that you (and not Mood Social) are collecting it, and must provide notice about and obtain user consent for your use of the content and information that you collect. Regardless of how you obtain content and information from users, you are responsible for securing all necessary permissions to reuse their content and information.
Automated Collection of Data
Your Places, Events or Moods must not collect users' content or information, or otherwise access Mood Social, using automated means (such as harvesting bots, robots, spiders, or scrapers) without written permission from Mood Social.
Calls to Action
Your Places, Events or Moods cannot use information obtained from a person’s interaction with your Page's call-to-action button for any purpose other than to provide the service associated with the call-to-action button. If you want to use this information for any other purpose, first obtain a person’s explicit consent.
5. Pages-Specific Policies
1. Page Names
Page names must not include profanity, excessively incorrect grammar or punctuation, and must not consist solely of generic terms or locations.
For example:
Profane language, including profanity that is partially obscured by asterisks or symbols
Misused capitalization, like using all capital letters in your Page name
2. Content Visibility
Content posted to a Place, Event or Mood is public and can be viewed by everyone who can see the Place, Event or Mood.
3. Profile Pictures
Your Place´s Profile picture must not include a verified checkmark, and also must not include third-party products, brands or sponsors.
5. Showmarks
Showmarks on Show Pages must accurately represent the show, and must not represent the parent entity or network.
6. Online Pharmacies
Places, Events or Moods must not promote the sale of prescription pharmaceuticals. Places, Events or Moods for online pharmacies may be permitted with Mood Social’s prior approval.
7. Age Gating
You must restrict access by age as necessary to comply with applicable laws and regulations as well as Mood Social terms and policies.
8. Post Preview
When sharing a third party link from your Place, Event or Mood, you must not edit any elements of the post preview.
9. Upload Functionality
You must not misuse Mood Social’s upload functionality in connection with your Place, Event or Mood
For example:
Uploading a static image as a video
10. Name Change and Merges
Name changes and merges must not result in a misleading or unintended connection and must not substantially change the Place’s, Event’s or Mood’s subject matter
11. Regulated Goods
Places, Events or Moods promoting the private sale of regulated goods or services (including alcohol, tobacco, or adult products) must restrict access to a minimum age of 18.
12. Driving Traffic to Third Party Apps and Sites
You must not accept anything of value to drive traffic to an app or site that engages in traffic arbitrage, or one that contains a disproportionate volume of ads relative to content, or content that is highly sexual, shocking, clickbait, or promotes scams.
6. Branded Content on Pages
Branded Content
Branded content must comply with the Mood Social Branded Content Policies.
Show Pages
Show Pages must not include branded content within show marks or show trailers, and must comply with the Mood Social Content Policies.
Necessary Disclosures
Your Place must include all necessary disclosures to people using Mood Social, such as any disclosures needed to indicate the commercial nature of the content posted by you.
7. Jobs on Pages Policies
Misleading, Deceptive, or Fraudulent Jobs
Job posts must not promote employment opportunities that are misleading, deceptive, or fraudulent.
For example:
Posts asking for payment prior to applying
Unclear business models that do not explicitly state how to make money or how value is created
Multi-level marketing schemes
Illegal Products and Services
Job posts must not promote employment opportunities that involve illegal activity, products, or services.
For example:
Counterfeit documents or currency
Use, sale, or service of illegal drugs
Human trafficking
Illegal criminal activity
Discrimination
Job posts must not unlawfully discriminate against applicants based on any protected characteristics, including, but not limited to, race, ethnicity, color, national origin, religion, age, sex, sexual orientation, gender identity, family status, disability, medical or genetic condition or any other basis protected under federal, state or local law. Job posts must comply with all applicable laws prohibiting discrimination.

Products and services sold on Mood Social Commerce Products must comply with our Terms and policies. Our Commerce Policies provide guidance on what types of products and services can be offered for sale on Mood Social. Sellers are also responsible for complying with all applicable laws and regulations. Failure to comply may result in a variety of consequences, including the removal of posted content. If you repeatedly post content that violates Mood Social policies, we may take additional action on your account.

10. Real Money Gambling Services
Posts may not promote or facilitate online gambling, games of skill or lotteries, including online casinos, sports books, bingo, or poker if it costs money.
11. Fraudulent, Misleading, Deceptive Or Offensive
Posts may not contain deceptive, false, misleading or offensive offers or products.
For example:
‘’Get rich quick” schemes
‘’Before and after” photos showing the effects of weight-loss products, surgeries, health products or anti-wrinkle products

12. Products With Overtly Sexualized Positioning
Posts may not position products or services in a sexually suggestive manner.

13. Subscriptions Or Digital Products
Posts may not promote the sale of downloadable digital content, digital subscriptions or digital accounts.
For example:
Posts with downloadable content, including PDFs, music, games, movies, etc.
Digital accounts, including Netflix accounts or games accounts
Digital subscriptions and internet streaming services, including TV, Mobile, Netflix, Spotify, etc.

14. Digital Media and Electronic Devices
Posts may not promote the sale of devices that facilitate or encourage streaming digital content in an unauthorized manner or interfering with the functionality of electronic devices.
For example:
Promoting the sale or use of streaming devices with KODI installed
Jailbroken or loaded devices
Jamming or descrambling devices
Etc.
15. Real, Virtual Or Fake Currency
Posts may not promote the sale of real, virtual or fake currency.
16. Third-Party Infringement
Posts may not contain content that infringes upon or violates the intellectual property rights of any third party, including copyright or trademark. This includes, but is not limited to, the promotion or sale of counterfeits, such as goods that copy the trademark (name or logo) and/or distinctive features of another company’s products to imitate a genuine product.
4. Restricted Content
The sale of the following is restricted on Mood Social Commerce Products:
1. Events Or Admission Tickets
Posts may not promote the sale of tickets, except with prior written permission from Mood Social.
2. Services on Marketplace
Home services may only be posted with Mood Social's written permission.
Brand Resources
These guidelines outline the general rules when using Mood Social’s brand assets and showcasing Mood Social content. Consistent use of these assets helps people easily recognize references to Mood Social and protect company trademarks.
Do keep enough space around Mood Social’s brand assets to keep them clear and uncluttered
Do maintain the shape and proportion of each of Mood Social’s brand assets and reproduce assets at a legible size.
Do follow other Mood Social terms and policies
Don’t assert rights over the Mood Social brand whether by trademark registration, domain name registration or anything else
Don’t modify Mood Socials’ brand assets in any way, such as by changing the design or color
Don’t use:
Trademarks, names, domain names, logos or other content that imitates or could be confused with Mood Social
Any icons, images or trademarks to represent Mood Social other than what is found on this resource center
Any combination of any part of the Mood Social brand with your name, marks or generic terms
Don’t represent the Mood Social brand in a way that:
Implies partnership, sponsorship or endorsement
Makes it the most distinctive or prominent feature of what you’re creating
Features Mood Social on materials associated with pornography, illegal activities, or other materials that violate the Mood Social Terms and policies
Talking About Mood Social
Sometimes you may need to refer to Mood Social to discuss it, describe your presence on Mood Social, display your Mood Social web address, indicate that your product is integrated with Mood Social, or describe your products or services as they relate to Mood Social.
Do display the word “Mood Social” in the same font size and style as the content surrounding it
Do capitalize the word “Mood Social” except when it’s part of a web address
Don’t pluralize the Mood Social trademark, use it as a verb or abbreviate it
Don’t use the Mood Social logo in place of the word “Mood Social”
Merchandising
Mood Social doesn’t permit or license its trademarks, logos or other intellectual property for use on merchandise or other products such as clothing, hats or mugs. In certain circumstances you can use the “M” logo on product packaging, but you need to follow the guidelines of use.
Legal
Mood Social’s trademarks, including Mood Social, the “M” logo, are owned by Next Creations AB and may only be used as provided in these guidelines or with Mood Social’s permission. A list of some of Mood Social trademarks can be found here. You may not use or register, or otherwise claim rights in any Mood Social trademark, including as or as part of any trademark, service mark, company name, trade name, username or domain registration. You should not use or claim rights in mood or social in a way that is confusingly similar to or dilutive of Mood Social, including as, or as any part of, a trademark. Do not use Mood Social's trademarks for anything that would be inconsistent with Mood Social’s terms or Community Standards.
We may revoke permission to use Mood Social trademarks at any time. Mood Social reserves the right to withhold approval of content that it feels is inconsistent with the Mood Social brand.
